Lightning Leads Ltd - Terms & Conditions for Professionals

These Terms and Conditions will apply to all professionals purchasing leads from Lightning Leads Ltd.

1. Definitions and Interpretation

• You / the “Professional” – means the person offering their professional services to Prospective Customers;
• The “website” – means https://www.lightningleads.co.uk/
• “Fees” – the fees payable by you the professional
• The “Services” – the professional services provided by a Professional to a Customer;


2. Purchasing Leads & Fees

2.1. To purchase leads from us, you will be required to register an account and attach a payment method to your account. The cost of leads will be location dependant and agreed prior to receiving any leads. 1. VAT (or local equivalent) shall be payable in addition to the agreed lead cost

2.2. The professional will confirm the number of leads they would like to receive on a monthly basis, Lightning Leads will generate up to that number each month, in some instances Lightning Leads will not be able to achieve the amount requested and in no way guarantee achieving a certain quantity.

2.3. Our billing cycle is weekly, all leads received from Friday to midnight Thursday will be charged on the Friday. Failure to make payment will result in lead generation being paused with immediate effect, multiple missed payments will result in account closure.


3. Refunds

3.1. Refunds will be issued if a lead is disputed and it is determined by Lightning Leads it isn’t a genuine lead.

3.2. You will only be entitled to a refund if: (a) A phone number provided to you is invalid, for example if it says “calls are not being connected to this number”; or (b) an email address provided to you by us isn’t functioning and you receive a bounce-back when using the email address; or (c) we can verify that the contact details provided are not for the person submitting the request.

3.3. Where you are entitled to receive a refund of a lead 3.2 above, you acknowledge that you will not receive a monetary refund for those leads, and we will instead provide you with an additional lead.


4. Intellectual Property Rights

The property and any copyright design rights or other intellectual property rights in any material, data or other information provided to you by Lightning Leads, including all information and content on the Website, (subject to any such rights of any third party) belong (or continue to belong) to Lightning Leads.

6. Termination

6.1. Without affecting any other right or remedy available to, Lightning Leads may withdraw your account registration as a Professional on the Website with immediate effect by giving you notice if: (a) you fail to pay any sums due to us during the Term; (b) if you receive a disproportionate number of complaints and/or bad reviews on the Website from Customers and/or Prospective Customers regarding your Services and/or dealings with customers more generally; (c) if, in our absolute discretion, we consider your registration as a Professional on the Website to be detrimental or potentially detrimental to the reputation of Lightning Leads; (d) you are subject to an investigation by a competent regulatory authority, including without limitation, the Information Commissioner, the Competition and Markets Authority or Trading Standards.

6.2 Without affecting any other right or remedy available to either of us, either you or we may withdraw your registration as a Professional on the Website with immediate effect by giving written notice to the other if: (a) the other party commits a material breach of any term of these Terms and Conditions; (b) the other party takes any step or action in connection with its entering administration, provisional liquidation or any composition or arrangement with its creditors (other than in relation to a solvent restructuring), being wound up, having a receiver appointed to any of its assets or ceasing to carry on its business; (c) the other party suspends, or threatens to suspend or cease or threatens to cease to carry on all or a substantial part of its business or (d) the other party’s financial position deteriorates to such an extent that it in the terminating party’s opinion the other party’s capability to adequately fulfil its obligations under these Terms and Conditions has been placed in jeopardy.
